1. Introduction & Acceptance
Welcome to Top Nomads Club (“TNC”, “we”, “our” or “us”).
By accessing or using our website (https://topnomads.club), purchasing memberships, booking services, or attending events, you agree to be bound by these Terms and Conditions.
If you do not agree, please refrain from using our services. These Terms apply to all users, members, and visitors of the platform.
2. Membership & Eligibility
Membership in TNC is available to individuals aged 18 and above.
By registering, you confirm that the information you provide is accurate and up to date.
TNC reserves the right to suspend or terminate memberships for violation of these Terms, misuse of services, or behaviour deemed harmful to the community.
Membership tiers (such as the Nomad Pass) provide access to exclusive benefits, which may vary by tier and may change from time to time.
Membership fees are payable in advance and may be renewed according to the subscription plan selected.
3. Services Provided
TNC provides lifestyle and event access, ticket booking, membership perks, and a concierge service that may include travel planning, flight bookings, hotel reservations, and curated tours.
We may also provide access to exclusive events, cultural experiences, and digital benefits linked to our membership tiers.
Please note that while TNC facilitates these services, the actual provision of flights, accommodations, and tours is managed by third-party providers.
Any arrangements made through our concierge service are subject to the terms and conditions of the respective providers.
4. Payments & Fees
All fees are payable in United States Dollars (USD), Nigerian Naira (NGN), or British Pounds (GBP), depending on the payment method selected.
The applicable currency will be displayed at checkout.
Payments for memberships and event tickets are non-refundable unless expressly stated otherwise.
Concierge service fees are payable upon booking confirmation and may be non-refundable even if the third-party provider issues a refund.
Additional charges such as taxes, processing fees, and currency conversion fees may apply depending on your location and payment provider.
TNC reserves the right to modify pricing at any time, with changes applying to future transactions only.
5. Cancellations & Refunds
Event tickets are generally non-refundable, unless otherwise stated at the point of purchase.
Some event tickets may be transferable, subject to TNC approval.
Travel bookings are subject to the cancellation and refund policies of the respective airlines, hotels, or tour operators.
TNC is not responsible for third-party cancellations, schedule changes, or denied services, though we will provide reasonable assistance in facilitating claims where possible.
Concierge service fees may remain non-refundable even if the provider issues a refund, as they cover administrative and coordination services provided by TNC.
6. User Conduct
Members and users agree not to resell, transfer, or misuse tickets, passes, or benefits without authorisation.
Users must comply with event rules, community guidelines, and applicable travel regulations.
Any misuse of services, disruptive behaviour at events, or abuse of the concierge service may result in membership suspension or permanent termination without refund.
7. Third-Party Services & Liability Disclaimer
TNC acts as an intermediary between members and third-party providers of flights, hotels, tours, and other services.
We do not control, guarantee, or assume responsibility for the performance, safety, or quality of third-party services.
Members acknowledge that TNC is not liable for delays, cancellations, accidents, injuries, or damages caused by third parties.
Any disputes regarding third-party services must be taken up directly with the provider.
8. Intellectual Property
All content, branding, logos, and digital assets displayed on the TNC platform are the intellectual property of Top Nomads Club.
Users may not copy, reproduce, or distribute this material without prior written consent.
Use of TNC branding or materials for commercial purposes without permission is strictly prohibited.
9. Privacy & Data
By using our services, you consent to the collection and use of personal information in line with our Privacy Policy.
We collect limited personal data to process bookings, manage memberships, and provide concierge services.
We implement reasonable safeguards to protect your data; however, you acknowledge that no system is completely secure, and we cannot guarantee the absolute security of information shared online.
10. Limitation of Liability
To the maximum extent permitted by law, TNC shall not be held liable for indirect, incidental, or consequential damages, including but not limited to lost profits, missed travel connections, lost or stolen property, or personal injury arising from use of third-party services.
Our total liability, whether in contract, tort, or otherwise, is limited to the amount paid by the member for the specific service giving rise to the claim.
Nothing in these Terms excludes liability for death or personal injury caused by our negligence, fraud, or any matter which cannot be excluded under applicable law.
11. Governing Law & Jurisdiction
These Terms are governed by the laws of the Federal Republic of Nigeria.
Any disputes arising under these Terms will be subject to the exclusive jurisdiction of Nigerian courts.
If any part of these Terms is found invalid or unenforceable, the remaining provisions will continue in full force and effect.
12. Changes to Terms
TNC reserves the right to update or revise these Terms at any time.
We will post changes on our website, and in some cases, we may notify members via email.
Continued use of our services after changes are made constitutes acceptance of the revised Terms.
Members are encouraged to review these Terms periodically to stay informed of updates.
